Data Processing Agreement

This agreement establishes the data handling relationship between Inframail Inc. (the processor) and customers using their email hosting services.

Definitions

Personal Data means any information relating to an identified or identifiable person. Processing means operations performed on such data. Data Controller means the customer. Data Processor means Inframail.

Roles and Responsibilities

Customers act as data controllers determining processing purposes, while Inframail processes information per customer instructions. Customers bear responsibility for lawfully collecting contact information.

Scope of Processing

The company processes personal information only as necessary to provide our services: hosting email inboxes, sending messages, and maintaining technical infrastructure. Data is not repurposed or commercialized.

Security Measures

Protection includes encryption during transmission, authentication systems, and continuous infrastructure monitoring, with access restricted to authorized staff.

Subprocessors

Third-party infrastructure providers may assist service delivery. Customers can request the subprocessor list, with all partners maintaining equivalent data protections.

Data Subject Rights

The company assists customers in fulfilling data access, removal, or modification requests from contacts.

Data Breaches

The company notifies customers without undue delay upon discovering unauthorized access incidents.

Deletion of Data

Account termination triggers data removal or anonymization within 30 days, barring legal retention obligations.

International Transfers

Cross-border data transfers include contractual safeguards such as Standard Contractual Clauses.

Governing Law

This agreement follows the same governing law and jurisdiction as Inframail's Terms of Service.
